§ 24-263. Exemptions.

  • The following shall be exempted wholly or in part from payment of the roads impact fee:

    (1)

    Alterations or expansion of an existing building where no additional units are created, the use is not changed, and where no additional vehicular trips will be produced over and above that produced by the existing use.

    (2)

    The construction of accessory buildings or structures which will not produce additional vehicular trips over and above that produced by the principal building or use of the land.

    (3)

    The replacement of a destroyed or partially destroyed building or structure in existence on or after February 1, 1986, with a new building or structure (a) of the same or a different use; provided that no additional trips will be produced over and above those produced by the original use of the land or (b) of the same or a different use producing additional trips but only for the original trips generated.

    (4)

    In those cases where a building permit or electrical permit for a recreational vehicle park or mobile home park was issued prior to February 1, 1986, but where the permit has since expired and more than 50 percent of the building construction was completed based on the last inspection.

    (5)

    Any claim of exemption must be made no later than the time of application for a building permit or electrical permit for a mobile home. Any claim not so made shall be deemed waived.
