§ 20-26. Power of building department to stop work in violation of article.

  • The building department of the county shall have the power to issue a written order requiring the cessation of any work or construction which takes place on waterfront property, bordering on the north fork of the St. Lucie River, if such work or construction is performed prior to obtaining a valid permit from the building department for such work; or, if such work being performed exceeds the authorization as set forth in the building department permit. The written order to cease any further construction or work within 50 feet of the shoreline shall be served by personal delivery to any person performing construction work on the particular property and a copy of the order shall be posted upon the property visible from the street, and a copy shall also be mailed by certified mail, return receipt requested, to the most recent address of the owner listed on the rolls of the property appraiser of the county. Posting of the notice on the subject property shall be prima facie evidence of the notice to owner. Failure to immediately abide by the cease and desist order issued by the building department shall constitute a separate offense for each day or portion of a day thereof that such work continues. Where a violation of this article exists, and is not fully cured, the building department shall not issue a certificate of occupancy.
