§ 18-64. Appeals.

  • (a)

    An applicant or certificate holder may appeal any decision made by the public safety director to the board by filing a petition of appeal with the county administration within 30 calendar days of the date of rendition of the decision. The board shall review the petition at a public meeting within 30 calendar days from the date of filing of the appeal. The petitioner shall be provided with notice of the time, date and place of the public meeting by certified mail, return receipt requested. Testimony at the public meeting shall be limited to ten minutes per side, unless an extension of time is granted by the board. The board's decision shall be final for the purpose of administrative appeals. The board's review of the petition shall be limited to the record and the facts which were available to the public safety director at the time of rendition of the decision appealed. The board shall reverse the decision of the public safety director if there is competent substantial evidence in the record which indicates the decision fails to comply with the article.

    (b)

    Any person aggrieved by a decision of the board pursuant to this article may, within 30 days after rendition of the decision, petition for certiorari review to the circuit court in the Nineteenth Judicial Circuit in and for the county.
