§ 9-1. Authority to create collection and disposal services.

  • (a)

    The Board of County Commissioners of St. Lucie County, Florida, be and they are authorized and empowered to create, establish, maintain and operate, directly or indirectly, garbage collection and disposal services in any part or parts of the territory within St. Lucie County which is not included in the corporate limits of any municipality therein.

    (b)

    Said board of county commissioners be and they hereby are authorized and empowered to charge and collect fees from the users of said garbage collection and disposal services in order to defray the cost and expenses, or any portion thereof, necessary for the establishment, maintenance and operation of said garbage collection and disposal services.

    (c)

    Said board of county commissioners be and they hereby are authorized and empowered to annually appropriate and expend from the general fund of St. Lucie County an amount not exceeding four thousand dollars ($4,000.00) in any one fiscal year for the purpose of paying a portion of the cost and expenses necessary for the establishment, maintenance and operation of said garbage collection and disposal services.

    (d)

    The garbage collection and disposal services provided for by this act [section] be and they hereby are declared to be a county purpose.

    (e)

    Said board of county commissioners for the purpose of establishing, maintaining and operating the garbage collection and disposal services provided for by this act are authorized and empowered to purchase, rent or lease such equipment, facilities and lands as may, within its discretion, be necessary for such purposes.

    (f)

    Said board of county commissioners be and they hereby are authorized and empowered, within its discretion, to contract with any municipality of St. Lucie County for the collection and disposal of garbage within the territory of St. Lucie County, which is not included in the corporate limits of that municipality.

    (g)

    Said board of county commissioners be and they hereby are authorized and empowered, within its discretion, to establish, maintain and operate garbage collection and disposal services, either directly or indirectly; that said board may, within its discretion, delegate the authority given by this act [section] to said board to collect and dispose of garbage, including the collection of fees from the users of said garbage collection and disposal services, to any agent, individual, corporation or company, and may contract with such parties as said board may see fit in order to carry out the purposes of this act [section].
